Term and Termination
This Agreement shall remain in effect until terminated by you or Groton.
Groton may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
This Agreement will terminate immediately, without prior notice from Groton, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the website and all copies thereof from your computer.
Upon termination of this Agreement, you shall cease all use of the website and delete all copies of the website from your computer.
Termination of this Agreement will not limit any of Groton’s rights or remedies at law or in equity in case of breach by you (during the term of this Agreement) of any of your obligations under the present Agreement.
Copyright Infringement Notice

To the maximum extent permitted by applicable law, in no event shall Groton or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the website, third-party software and/or third-party hardware used with the website, or otherwise in connection with any provision of this Agreement), even if Groton or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some states/jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Severability
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
This Agreement, together with the Privacy Policy and any other legal notices published by Groton on the Services, shall constitute the entire agreement between you and Groton concerning the Services. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and Groton.”’s” failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision. Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Agreement shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute waiver of any subsequent breach.
No failure to exercise, and no delay in exercising, on the part of either party, any right or any power under this Agreement shall operate as a waiver of that right or power. Nor shall any single or partial exercise of any right or power under this Agreement preclude further exercise of that or any other right granted herein. In the event of a conflict between this Agreement and any applicable purchase or other terms, the terms of this Agreement shall govern.
Amendments to this Agreement
Groton reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our website after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use Groton.
Entire Agreement
The Agreement constitutes the entire agreement between you and Groton regarding your use of the website and supersedes all prior and contemporaneous written or oral agreements between you and Groton.
You may be subject to additional terms and conditions that apply when you use or purchase other Groton’s services, which Groton will provide to you at the time of such use or purchase.
Updates to Our Terms
We may change our Service and policies, and we may need to make changes to these Terms so that they accurately reflect our Service and policies. Unless otherwise required by law, we will notify you (for example, through our Service) before we make changes to these Terms and give you an opportunity to review them before they go into effect. Intellectual Property
The website and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by Groton, its licensors or other providers of such material and are protected by South Korea and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. The material may not be copied, modified, reproduced, downloaded or distributed in any way, in whole or in part, without the express prior written permission of Groton, unless and except as is expressly provided in these Terms & Conditions. Any unauthorized use of the material is prohibited.
Agreement to Arbitrate
This section applies to any dispute EXCEPT IT DOESN’T INCLUDE A DISPUTE RELATING TO CLAIMS FOR INJUNCTIVE OR EQUITABLE RELIEF REGARDING THE ENFORCEMENT OR VALIDITY OF YOUR OR Groton.”’s” INTELLECTUAL PROPERTY RIGHTS. The term “dispute” means any dispute, action, or other controversy between you and Groton concerning the Services or this agreement, whether in contract, warranty, tort, statute, regulation, ordinance, or any other legal or equitable basis. “Dispute” will be given the broadest possible meaning allowable under law.
Notice of Dispute
In the event of a dispute, you or Groton must give the other a Notice of Dispute, which is a written statement that sets forth the name, address, and contact information of the party giving it, the facts giving rise to the dispute, and the relief requested. You must send any Notice of Dispute via email to: grotoninternational@gmail.com. Groton will send any Notice of Dispute to you by mail to your address if we have it, or otherwise to your email address. You and Groton will attempt to resolve any dispute through informal negotiation within sixty (60) days from the date the Notice of Dispute is sent. After sixty (60) days, you or Groton may commence arbitration.
Binding Arbitration
If you and Groton don’t resolve any dispute by informal negotiation, any other effort to resolve the dispute will be conducted exclusively by binding arbitration as described in this section. You are giving up the right to litigate (or participate in as a party or class member) all disputes in court before a judge or jury. The dispute shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Either party may seek any interim or preliminary injunctive relief from any court of competent jurisdiction, as necessary to protect the party’s rights or property pending the completion of arbitration. Any and all legal, accounting, and other costs, fees, and expenses incurred by the prevailing party shall be borne by the non-prevailing party.
Submissions and Privacy
In the event that you submit or post any ideas, creative suggestions, designs, photographs, information, advertisements, data or proposals, including ideas for new or improved products, services, features, technologies or promotions, you expressly agree that such submissions will automatically be treated as non-confidential and non-proprietary and will become the sole property of Groton without any compensation or credit to you whatsoever. Groton and its affiliates shall have no obligations with respect to such submissions or posts and may use the ideas contained in such submissions or posts for any purposes in any medium in perpetuity, including, but not limited to, developing, manufacturing, and marketing products and services using such ideas.
Promotions
Groton may, from time to time, include contests, promotions, sweepstakes, or other activities (“Promotions”) that require you to submit material or information concerning yourself. Please note that all Promotions may be governed by separate rules that may contain certain eligibility requirements, such as restrictions as to age and geographic location. You are responsible to read all Promotions rules to determine whether or not you are eligible to participate. If you enter any Promotion, you agree to abide by and to comply with all Promotions Rules.
Additional terms and conditions may apply to purchases of goods or services on or through the Services, which terms and conditions are made a part of this Agreement by this reference.
Typographical Errors
In the event a product and/or service is listed at an incorrect price or with incorrect information due to typographical error, we shall have the right to refuse or cancel any orders placed for the product and/or service listed at the incorrect price. We shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account or other payment account in the amount of the charge.
Miscellaneous
If for any reason a court of competent jurisdiction finds any provision or portion of these Terms & Conditions to be unenforceable, the remainder of these Terms & Conditions will continue in full force and effect. Any waiver of any provision of these Terms & Conditions will be effective only if in writing and signed by an authorized representative of Groton. Groton will be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety) in the event of any breach or anticipatory breach by you. Groton operates and controls the Groton Service from its offices in South Korea. The Service is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Accordingly, those persons who choose to access the Groton Service from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable. These Terms & Conditions (which include and incorporate the Groton Privacy Policy) contains the entire understanding, and supersedes all prior understandings, between you and Groton concerning its subject matter, and cannot be changed or modified by you. The section headings used in this Agreement are for convenience only and will not be given any legal import.

The Groton Academy website (grotonacademy.org) and all pages on that domain The Groton Academy mobile application All services provided through the above, including class management, learning management, and parent communications We serve students and their families at Groton Academy, an English education institution located in Gangnam-gu, Seoul, South Korea. Our users are primarily located in South Korea, and this policy is written primarily to comply with the Personal Information Protection Act (PIPA) of South Korea. Where relevant, we also address compliance with the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).
By using our website or App, you acknowledge that you have read and understood this Privacy Policy.
Student’s Korean name (required) Student’s English name (optional — note: this is a non-legal name chosen by the student, not an official name) Parent or guardian’s name (where provided at registration)** (required) Parent or guardian’s email address (required — used as the login credential and primary contact) Parent or guardian’s phone number (required — collected for enrollment verification; see Section 3.5) Accounts are created by a parent or guardian on the student’s behalf, or with assistance from academy staff when needed. The same account is shared between the parent and student throughout the student’s enrollment.
Usernames are formatted as the student’s English name combined with the last four digits of the parent’s phone number for internal identification purposes. Usernames are visible within the platform as described in Section 3.2.
When you register, your registration information (including phone number) is also sent to a secure Google Sheets document accessible only to Frontdesk staff. This is used solely to verify enrollment and is cleared each semester. See Section 5 for details on overseas data transfers.
3.2 Platform Activity (Website and App) When you use our platform as a registered user, we collect and store:
BuddyBoss profile information: username, profile photo (uploaded voluntarily by the parent or student), and membership in class groups Class group activity: posts, comments, and media shared within your assigned private class group. Each student is assigned to a private group visible only to group members (classmates, teacher, and academy staff) Private messages: messages sent between students/parents and their teacher or Frontdesk staff via the BuddyBoss messaging system Course data: course enrollment, lesson completion status, and quiz scores recorded by LearnDash Class records: class assignment and teacher assignment managed through our Frontdesk system Class group media: photos and videos uploaded by teachers to private class group albums documenting class activities Usernames appear in the BuddyBoss member directory (accessible to all registered users), class group posts, course progress records, and comment threads. Because usernames contain the student’s English name and the last four digits of the parent’s phone number, they function as a personal identifier within the platform.
3.3 Automatically Collected Information (Website) When you visit grotonacademy.org, our servers and third-party services automatically collect:
IP address and approximate location Browser type, version, and language Device type and operating system Pages visited, time of visit, and time spent on each page Referring URL (the page you came from) This information is recorded in server access logs (retained approximately 30 days) and processed by our CDN provider QUIC.cloud (retention varies; see Section 5). It is used for security monitoring, performance optimization, and internal analytics. It is not used to build marketing profiles.

WordPress login session management BuddyBoss profile and activity preferences LearnDash course progress tracking Language preference (via gtranslate) These are functional cookies necessary for the platform to operate. We do not use advertising, tracking, or analytics cookies.
3.4 Mobile App — Additional Data When you use the Groton Academy mobile App, the following additional data is collected beyond what the website collects:
Push notification identifiers:
A OneSignal Subscription ID is generated for your device when you install the App and grant notification permission. This identifier is associated with your WordPress user account on our server and is used to send you targeted push notifications (class updates, teacher messages, schedule changes). An FCM token (Firebase Cloud Messaging token) is generated by Google’s Firebase service on Android devices and transmitted to OneSignal to enable push delivery. An APNs token is generated by Apple on iOS devices for the same purpose. Device information collected by OneSignal and Firebase:

It is transmitted to OneSignal (US) and Google Firebase (US). See Section 5 for overseas transfer details.
Notification permission: The App requests permission to send push notifications when first launched. You can grant or revoke this permission at any time in your device’s system settings (Android: Settings → Apps → Groton Academy → Notifications). You can also manage notification preferences from within the App via the notification settings screen.
File uploads: The App does not directly access your camera, microphone, or photo library. When you upload a file through the website within the App, Android’s standard OS-mediated file chooser is presented, allowing you to select files you choose to share. The App itself does not retain access to your device’s files beyond the specific file you select for upload.
No additional tracking: The App does not use crash reporting services, analytics SDKs, or advertising networks beyond OneSignal and Firebase (FCM) described above.
3.5 Phone Number Use The parent or guardian’s phone number is collected at registration. It is:

6.1 Parental Consent Accounts for students under 14 years of age may only be created by a parent or legal guardian. At the time of registration, the parent or guardian must:
Confirm that they are the parent or legal guardian of the student Provide explicit consent to the collection and use of the student’s personal information as described in this policy Provide explicit consent to the overseas transfer of personal information to the third-party services listed in Section 5 These consents are obtained via mandatory checkboxes on the registration form. Registration cannot be completed without completing these consent steps.
6.2 Enrollment Verification After registration, a Frontdesk staff member contacts the registered parent or guardian by phone to confirm enrollment before classes begin. This serves as an additional verification that the account was created by an adult.
6.3 Shared Family Account The student’s account is a shared family account. The parent or guardian who creates the account retains co-access throughout the student’s enrollment. There is no separate parent account — the single account is used by both the student (for coursework and platform activity) and the parent (for monitoring progress and communicating with teachers).
6.4 What Children’s Data We Hold For students under 14, we hold:
Korean name, English name (non-legal) Participation in private class groups (posts, comments, media) Course enrollment and progress (lesson completion, quiz scores) Private message history with teachers and Frontdesk staff Profile photo (uploaded by the parent or with parent supervision) Class records (class assignment, teacher assignment) 6.5 Profile Photos of Minors Profile photos are not required. When a profile photo is uploaded, it is visible to all registered users on the platform. We encourage parents to consider carefully before uploading photos of minors. Profile photos can be removed at any time by logging into the account.
Photos and videos of students taken during class activities are uploaded by teachers to private class group albums. These are visible only to class group members (the student, classmates, teachers, and academy staff). These albums are hidden from member access at the end of each academic year but remain stored on our server (see Section 7 for retention details).
6.6 No Marketing to Children We do not send marketing communications to students of any age. Push notifications and emails are strictly operational and educational in nature (class updates, schedule changes, teacher messages, assignment reminders). We do not build advertising profiles on students and do not share student data with advertisers.
6.7 No Automated Decision-Making We do not make automated decisions about students based on their data. No algorithmic profiling, adaptive sorting, or automated scoring affects a student’s experience on the platform.

Right to suspend processing: You may request that we suspend processing of your personal information without deleting your account. We will set the account to inactive status, disabling login and suspending active data processing.
Right to data portability: We do not currently provide a formal data export service. For photos and other content you have uploaded, you may download your own content directly from the platform. For other data export requests, please contact us and we will respond within 10 days.
Right to withdraw consent: You may withdraw consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal. Withdrawing consent for data collection may affect your ability to use the platform.

3.2 플랫폼 활동 (웹사이트 및 앱) 등록된 이용자가 플랫폼을 사용할 때 다음 정보를 수집 및 저장합니다:
BuddyBoss 프로필 정보: 사용자명, 프로필 사진(학부모 또는 학생이 자발적으로 업로드), 수업 그룹 멤버십 수업 그룹 활동: 배정된 비공개 수업 그룹 내에서 공유된 게시물, 댓글, 미디어. 각 학생은 그룹 구성원(반 친구, 담당 선생님 및 학원 직원)만 볼 수 있는 비공개 그룹에 배정됩니다. 쪽지: BuddyBoss 메시지 시스템을 통해 학생/학부모와 담당 선생님 또는 프론트데스크 직원 간에 주고받은 메시지 수업 데이터: LearnDash에 의해 기록된 강좌 등록, 수업 완료 현황 및 퀴즈 점수 수업 기록: 프론트데스크 시스템을 통해 관리되는 수업 배정 및 담당 선생님 배정 수업 그룹 미디어: 수업 활동을 기록하기 위해 선생님이 비공개 수업 그룹 앨범에 업로드한 사진 및 영상 사용자명은 BuddyBoss 회원 디렉터리(등록된 모든 이용자가 접근 가능), 수업 그룹 게시물, 수업 진도 기록 및 댓글에 표시됩니다. 사용자명에는 학생의 영어 이름과 학부모 전화번호 뒤 4자리가 포함되어 플랫폼 내에서 개인 식별자로 기능합니다.
3.3 자동 수집 정보 (웹사이트) grotonacademy.org를 방문할 때 서버 및 제3자 서비스가 자동으로 다음 정보를 수집합니다:

파일 업로드: 앱은 카메라, 마이크 또는 사진 보관함에 직접 접근하지 않습니다. 앱 내 웹사이트에서 파일을 업로드할 경우, Android의 표준 OS 파일 선택 화면이 나타나며 이용자가 직접 공유할 파일을 선택합니다. 앱 자체는 업로드를 위해 선택한 특정 파일 외에 기기의 파일에 접근하지 않습니다.
추가 추적 없음: 앱은 위에서 설명한 OneSignal 및 Firebase(FCM) 외에 충돌 보고 서비스, 분석 SDK 또는 광고 네트워크를 사용하지 않습니다.
3.5 전화번호 이용 학부모 또는 법정대리인의 전화번호는 가입 시 수집됩니다. 전화번호는 다음의 목적으로 사용됩니다:

6.2 등록 확인 가입 후 프론트데스크 직원이 수업 시작 전 등록된 학부모 또는 법정대리인에게 전화로 연락하여 등록 여부를 확인합니다. 이는 계정이 성인에 의해 생성되었음을 추가로 확인하는 절차입니다.
6.3 가족 공유 계정 학생 계정은 가족 공유 계정입니다. 계정을 생성한 학부모 또는 법정대리인은 재학 기간 내내 계정에 접근할 수 있습니다. 별도의 학부모 계정은 없으며, 하나의 계정이 학생(수업 및 플랫폼 활동 목적)과 학부모(진도 확인 및 선생님과의 소통 목적) 모두에 의해 사용됩니다.
6.4 아동 개인정보 보유 항목 만 14세 미만 학생에 대해 당사는 다음 정보를 보유합니다:

수업 활동 중 촬영된 학생의 사진 및 영상은 선생님이 비공개 수업 그룹 앨범에 업로드합니다. 이는 수업 그룹 구성원(학생, 반 친구, 선생님 및 학원 직원)만 볼 수 있습니다. 이러한 앨범은 매 학년도 말에 회원 접근이 제한되지만 서버에는 계속 저장됩니다(보관 기간은 7항 참조).
6.6 아동 마케팅 금지 당사는 어떤 연령의 학생에게도 마케팅 정보를 발송하지 않습니다. 푸시 알림 및 이메일은 엄격히 운영 및 교육 목적(수업 업데이트, 일정 변경, 선생님 메시지, 과제 알림)으로만 발송됩니다. 학생에 대한 광고 프로파일을 구축하지 않으며 학생 데이터를 광고주와 공유하지 않습니다.
6.7 자동화된 의사결정 없음 당사는 이용자의 데이터를 기반으로 자동화된 의사결정을 내리지 않습니다. 알고리즘 프로파일링, 자동화된 분류 또는 자동 점수 산정은 플랫폼에서의 학생 경험에 영향을 미치지 않습니다.
